Rick Hansen 25th Anniversary Relay Contest
Official Rules and Regulations
This Promotion is intended for viewing and participation by legal residents of Canada only and will be subject to and construed in accordance with the laws of British Columbia and the federal laws of Canada applicable therein. Only those having reached the age of 13 years at time of entry are eligible to enter. Entry into this Contest constitutes your acceptance of these Official Rules and Regulations. Any Entrant under the applicable provincial age of majority at the time of entry requires parental/legal guardian approval to enter the Contest.
1) Eligibility: The "Rick Hansen 25th Anniversary Relay Contest" ("the Contest") is free to enter and open to legal residents of Canada who are 13 years of age or older at time of entry and are physically present in Canada, except employees (or those with whom they are domiciled) of the Rick Hansen Foundation- 300-3820 Cessna Drive Richmond, BC V7B 0A2 (the "Sponsor"), FCV Technologies Ltd.- 1100-333 Seymour Street, Vancouver, BC V6B 5A6 (the "Administrator") and Consumer-Response Marketing Ltd.- 16-19272 96th Ave, Surrey, BC V4N 4C1 (the "Judging Organization").
2) Agreement to Official Rules: By participating in the Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, the Administrator, and/or Judging Organization which decisions are final and binding in all matters related to the Contest. Whether a selected entrant receives a prize is contingent upon such entrant fulfilling all requirements set forth herein.
3) Contest Regions: There are four separate Contest regions across Canada consisting of (a) Atlantic/Quebec Region (Newfoundland, Nova Scotia, Prince Edward Island, New Brunswick, and Quebec) (b) Ontario Region, (c) Prairie Region (Manitoba, Saskatchewan, and Alberta) and (d) British Columbia Region.
4) Contest Periods: The overall Contest opens April 5, 2011 at 12:01:00 Pacific Time ("PT"). The Contest closes for Atlantic/ Quebec Region at 23:59 (PT) on June 1, 2011; for Ontario Region at 23:59 (PT) on August 3, 2011; for Prairie Region at 23:59 (PT) on October 26, 2011; and for BC Region at 23:59 (PT) on December 28, 2011. The Administrator's computer is the official time-keeping device for the Contest.
5) How to Enter: NO PURCHASE NECESSARY. To participate in the Contest visit rickhansenrelay.com and click on the link "A Chance to Join the Relay". Follow the prompts and provide all required information. Each entrant must select the community where he/she prefers to participate in the Rick Hansen 25th Anniversary Relay (the "Relay"). The entrant has the sole option of sharing his/her story of how they have made a difference in their community through determination, courage, leadership or teamwork. There is also the option of selecting a category from a drop-down menu on how he/she is making a difference. Exercising either of these options over the other will not increase the chance of winning a prize. The exact number of openings for the relay in any particular community will be determined by the Sponsor in its sole and exclusive discretion and the Sponsor reserves the right to award a position in the relay to an entrant in a community within such entrant's region other than the community which the entrant identified as their preferred community at the time of entry. Persons under the age of 13 years may not enter the Contest. Persons under the applicable provincial age of majority at the time of entry will be required to confirm that they have obtained their parent or legal guardian's consent to their entry, and provide the name and email address of their parent or legal guardian, to proceed with the entry process. Persons under the age of majority in their Province of residence at the time of entry will require parental/legal guardian permission prior to being awarded a prize in the Contest. Upon successful completion of the entry process entrants will receive a message thanking them for their entry and providing additional information regarding the Contest.
LIMIT one entry per person and per email address. Multiple entrants may not enter from the same email address. Any attempt by any entrant to obtain more than one entry by using multiple/different email addresses, identities, registrations, and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which may be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
6) Prizes: There are 2500 (two thousand five hundred) prizes available to be won in the Contest, with a regional allocation of 750 prizes for Atlantic/Quebec Region, 500 prizes for the Ontario region, 750 prizes for the Prairie Region and 500 prizes for the BC Region. Each prize consists of the opportunity to be a participant in the Rick Hansen 25th Anniversary Relay in a selected Canadian community on a specific date and time assigned by the Sponsor in its sole discretion. The opportunity to participate is priceless; no retail value can be assigned. Prize also includes a Rick Hansen 25th Anniversary Relay Medal manufactured by the Royal Canadian Mint and a Relay Track Suit which together have an approximate retail value of $122.00 CDN.
Each winner and parent or legal guardian (if applicable) are responsible for their own transportation to and from the relay event and any and all other costs associated with participation. Prizes are non-transferable and no substitution will be made unless the Sponsor, in its sole discretion, determines otherwise. The prize must be accepted as awarded and the odds of winning are dependent upon the total number of eligible entries received for each region during that Contest Period. The prize will be awarded on the day and place of winner's relay participation. If, for any reason the prize winner is unable to participate in the relay on the prearranged date and time the prize will be forfeited and the Sponsor may randomly select another entrant to receive such forfeited prize.
7) Prize Draw: A random draw will be held at or around 10:00 AM Pacific Time on the day following each region's closing date (as set out in Rule 4) from all eligible entries received for that region to choose that region's winning entrants. Selected entrants will be notified by way of email notice sent to the email address provided by the entrant at the time of entry. If any selected entrant does not respond to the Judging Organization's email within 3 days of it being sent, another selected entrant will be randomly selected for the same prize.
8) To Redeem Prize: Before being declared a winner, each selected entrant must correctly answer unaided, a time-limited mathematical skill-testing question administered by email (as outlined in Rule 7) and must also complete and return the attached emailed Prize Compliance and Waiver of Publicity/Liability forms within 3 days of such forms being sent to the selected entrant. If the selected entrant fails to respond to the email within the 3 days they will automatically be disqualified and another selected entrant will be randomly selected for the same prize.
If a selected entrant is unwilling or unable to comply in full with these rules (including being unavailable to participate in the Relay in the community on the date and time designated by the Sponsor), the prize will be forfeited and another entrant will be selected to receive such forfeited prize. If a selected entrant is under the age of majority in their province of residence at the time of entry, a parent or legal guardian will be required to sign the forms.
In signing the Prize Compliance and Waiver of Publicity/Liability forms the selected entrant is (i) confirming compliance with these Contest Rules, (ii) confirming acceptance of the prize as awarded and willingness to conform to such rules and regulations governing participation in the Rick Hansen 25th Anniversary Relay, including standards of physical capability appropriate to the Relay participation, and the comportment of participants, (iii) releasing the Sponsor, their advertising and promotion agencies, the Judging Organization and each of their respective officers, directors, agents, representatives, volunteers, successors and assigns (collectively, the "Released Parties") from any liability in connection with this Contest, the entrant's participation therein and/or the awarding and use of the prize or any portion thereof including, but limited to personal injury, death, or damage to or loss of property; and consenting to the use of his/her name, city or province/territory and/or photograph, the right to use the submitted essay (where applicable), without further authorization, communication or compensation, in any publicity or advertisement carried out by the Sponsor, or its affiliates or assigns in any manner whatsoever, including print, broadcast or the Internet.
9) General Conditions: All entries submitted become the property of the Sponsor, Administrator, and Judging Organization. The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux, to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion.
The Sponsor has the right to verify an entrant's eligibility and compliance with these Contest Rules, and to disqualify, in the Sponsor's sole discretion, an entrant on the basis of its investigation in that regard.
Entrants may not enter this Contest with multiple e-mail and/or street addresses, nor may entrants use any other device or artifice to submit more than one (1) entry per email address. If an entrant uses fraudulent entry methods, or otherwise attempts to participate with multiple e-mail and/or street addresses under multiple identities, or use any device or artifice to enter more than one (1) entry, such entrants will be disqualified.
10) Liability Provisions: The Sponsor, the Administrator, and the Judging Organization are not responsible for human error, theft, destruction, or damage to your entry, or other factors beyond its reasonable control. Entrants assume all risk of damaged, lost, late, incomplete, invalid, incorrect or misdirected entries. The Sponsor makes no warranty, representation or guarantee, express or implied, in connection with its ability to in any way enable, develop or market the idea set forth in these Contest Rules, any associated promotional materials or the entry form(s) completed by contest entrants.
The Sponsor shall not be liable to a winner or any other person for failure to supply the Prize or any part thereof, by reason of the Prize becoming for reasons beyond the reasonable control of the Sponsor unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labor disputes, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond the Sponsors' control.
The Sponsor, the Administrator, and the Judging Organization and their respective employees, volunteers, officers, directors, agents, contractors, representatives, affiliates, divisions, subsidiaries, resellers, dealers, distributors, and advertising/promotion agencies (collectively the "Released Parties") shall not assume any responsibility whatsoever for any of the following: delayed, failed, partial or garbled computer transmissions; technical failures of any kind, including, but not limited to, lost, interrupted or unavailable network, server, Internet Service Provider (ISP), Contest website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failures or difficulties; the incorrect or inaccurate capture or failure to capture information whether caused by Contest website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest submission, or other information; the failure to capture any such information; or errors of any kind whether human, mechanical, electronic, network or otherwise arising out of or relating to the Contest, theft, loss, destruction or damage to the Contest submissions, in whole or in part, or other factors beyond their reasonable control. The Released Parties are not responsible for injury or damage to an entrant's or to any other person's computer related to or resulting from participating in the Contest or downloading materials from or use of the Contest website.
CAUTION: ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE THE SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF APPLICABLE CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR AND THE ADMINISTRATOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW AND TO DISQUALIFY YOU FROM THE CONTEST.
LIMITATIONS OF LIABILITY AND RELEASE: BY ENTERING THE CONTEST, YOU AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE RELEASED AND HELD HARMLESS BY YOU AND YOUR HEIRS, EXECUTORS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS FOR ANY CLAIMS, LIABILITIES, OR CAUSES OF ACTION OF ANY KIND OR NATURE FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES TO PERSONS, INCLUDING, WITHOUT LIMITATION, DISABILITY OR DEATH, AND DAMAGE TO PROPERTY, DUE IN WHOLE OR IN PART, ARISING DIRECTLY OR INDIRECTLY, NOW OR IN THE FUTURE FROM THE DELIVERY, ACCEPTANCE, USE OR MISUSE OF THE PRIZE, ANY AND ALL USE AS PROVIDED HEREIN OF YOUR CONTEST SUBMISSION, OR PARTICIPATION IN THIS CONTEST AND/OR ANY RELATED ACTIVITY. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE CONTEST WEBSITE SITE AND EVERYTHING THAT MAY BE DISTRIBUTED IN CONNECTION WITH THE PRIZE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, IN WHICH CASE SUCH LIMITATION OR EXCLUSION SHALL APPLY ONLY TO THE EXTENT PERMITTED BY THE LAW IN THE RELEVANT JURISDICTION.
11) Choice of Law: Subject to all applicable Canadian federal, provincial and municipal laws and regulations, these Contest Rules govern all aspects of the Contest and are binding on all participants. For Quebec residents, any litigation respecting the conduct and awarding of the prize in this publicity contest may be submitted to the Régie des alcools, des courses et des jeux; 1, rue Notre-Dame Est, Montréal (Québec), H2Y 1B6.
12) Privacy Policy: By entering information on the Contest entry form, entrants consent to the use of such information by the Sponsor, the Administrator, and the Judging Organization to administer, implement and fulfill this Contest. Information collected from entrant will be processed in accordance with the Rick Hansen Foundation Privacy Policy posted on the website rickhansenrelay.com.
